General Terms and Conditions of Youboost-Promotion

Scope These General Terms and Conditions (GTC) set the foundation of the contractual relationship between Youboost-Promotion, hereinafter referred to as the "Provider," and customers who utilize the Provider's services. These GTC apply both within the Principality of Liechtenstein and internationally, subject to the express or implied agreement of the parties.

Legal Basis The GTC and all legal relationships arising from the contractual relationship between the Provider and the customer are governed by the law of the Principality of Liechtenstein. This applies regardless of where the contractually agreed services are performed.

Contract Modifications All changes and additions to these General Terms and Conditions, as well as any side agreements, must be made in writing to be valid. The requirement for written form is only fulfilled if both parties mutually confirm changes or additions in writing.

Contracting Parties By using the services, the customer enters into a contractual relationship with Youboost-Promotion. Youboost-Promotion is registered at the following address: Address: Gewerbestrasse 3, 9496 Balzers, Principality of Liechtenstein Represented by the managing directors: Flamur Sacipi and Moreno Carroccia

Subject of the Contract This contract governs the purchase of services provided by the Provider through its website and other sales channels. Detailed information and specifications about individual services can be found in the product descriptions on the respective offer pages. The Provider assumes no liability for errors or omissions in the product descriptions. Customers requiring further information or having specific questions about the services are encouraged to contact the Provider directly. By using the services, the customer agrees to acknowledge and comply with the terms specified on the website.

Conclusion of Contract The contract is concluded either through the Provider's website as part of electronic commerce or by using remote communication means such as telephone and email. The services presented on the website serve as a non-binding invitation to the customer to submit a binding offer by placing an order. This offer may be accepted or rejected by the Provider. A contract is only concluded when the Provider sends an explicit order confirmation. An automatically generated order confirmation after the order does not constitute a legally binding acceptance of the contract. A contract can also become legally effective through the actual delivery of the goods or the commencement of service provision.

Duration of the Contract and Payment Terms The total price for the services is determined at the time of order confirmation and remains valid until the full receipt of the agreed services, which usually occurs within 72 hours after confirmation or according to the agreed duration. Strict compliance with the "Guidelines for Videos and Content," as defined in Section 13, is essential for the successful execution of the service. Violations of these guidelines may impair the performance of the service and affect the final billing.

Technical Requirements Customers are responsible for providing the technical requirements needed to use the services, including a valid internet connection, an email address, and a payment method. Customers bear the costs for these technical requirements themselves. The Provider assumes no liability for technical disruptions that may affect the use of the services.

Liability The information provided by Youboost-Promotion is based on the best of its knowledge and belief. However, the Provider assumes no liability for errors or inaccuracies in the information provided, documents, or data carriers.

Prices All stated prices are final prices and include the statutory VAT. The price information on the website is binding. If a legal right of withdrawal exists, the specific conditions applicable to its exercise shall apply.

Delivery Conditions The service begins immediately after the order is received, typically between 12 and 72 hours after the order is placed to the YouTube link provided by the buyer. Delays caused by circumstances such as inadequate content, rejection of the video by YouTube, disputes against the video, or a necessary expansion of the target audience may affect the agreed delivery times.

Duration for Views The specified duration for service delivery in days serves as a guideline. Depending on the type of content and Google Ads' delivery speed, the actual duration may vary. This is particularly the case if special circumstances, such as fluctuating demand or technical limitations, exist. The Provider does not guarantee adherence to the specified duration but will take all reasonable measures to deliver the service within the desired time frame.

Warranty Youboost-Promotion guarantees that the ordered views will be initiated within 12 to 72 hours to the YouTube link provided by the buyer. Errors in transmission due to omissions by the buyer are the buyer's responsibility, and they will bear the resulting costs. If the views are not publicly counted by YouTube but registered as views in our ad account, the delivery is considered complete. Refunds are only issued in the form of vouchers. If the customer cancels the order during or after the start of service fulfillment, Youboost-Promotion reserves the right to charge a cancellation fee of 25% of the order value. Refund claims must be made by the customer within 14 days of delivery.

Guidelines for Videos and Content The customer is fully responsible for ensuring that the content they create is legally permissible. Youboost-Promotion does not conduct legal reviews of the content; however, advertising content may be reviewed by Google Ads. Youboost-Promotion reserves the right to refuse the promotion of certain content, including but not limited to:

• Political content
• Illegal activities
• Racism, fascism, extreme speciesism
• Content with an age restriction of 18+
• Sexual content
• Competitions, votes, sweepstakes
• Gambling, betting
• Trading in securities, cryptocurrencies, etc.
• Multi-level marketing / network marketing
• Violent or offensive content

Disclaimer Claims for damages against Youboost-Promotion are excluded, except in cases of gross negligence or intentional breach of duty by Youboost-Promotion, its legal representatives, or vicarious agents.

Prohibition of Assignment and Pledge Without the Provider's consent, claims or rights of the customer against Youboost-Promotion may not be assigned or pledged. An exception exists if the customer can demonstrate a legitimate interest in the assignment or pledge.

Language, Jurisdiction, and Applicable Law The parties agree to apply the law of the Principality of Liechtenstein. The place of jurisdiction for all disputes arising from or in connection with these GTC is the Provider's registered office in Balzers, Principality of Liechtenstein.

Severability Clause If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, a rule that comes closest to the purpose of the original provision and is legally permissible shall apply.
